Local Laws to be Observed by Lewistown’s Residents and Guests

The safety and comfort of all will be enhanced when Lewistown’s residents and guests observe these local laws.

Alcohol: Driving under the influence of alcohol or with an open container is a criminal offense. Persons under the age of 21 may not consume or possess any alcoholic beverage. There is no prohibition of consuming alcoholic beverages in city parks. However, such beverages may not be sold at city parks. Alcohol may not be sold anywhere from 2 to 8 a.m.

Campers and RVs: No person may park any motor vehicle for camping purposes in the city, including private property, except in an authorized tourist park. No motor vehicle may be parked on any street within the city for a period greater than five consecutive days. RVs which do not exceed eight feet in width and 27 feet in length may be parked or stored in rear yards. There is no parking allowed in alleys. All parking restrictions that apply to cars also apply to RVs.

City Parks: There is no camping or overnight sleeping allowed in city parks without special advance permission from the Lewistown Park Board.

Curfews: Children under the age of 12 may not be upon any public thoroughfare or in any public place without acceptable supervision Sun-day-Thursday from 9 p.m.-6 a.m. and Friday-Saturday from 10 p.m.-6 a.m. For children ages 12-17, the above rule applies Sunday-Thursday from 10:30 p.m.-6 a.m. and Friday-Saturday from 12:30 a.m.-5 a.m.

Door-to-Door Sales: All salesmen, including door-to-door, whether they live within or outside the city, must obtain a city business license.

Fireworks: The sale or discharge of fireworks is prohibited within the city limits. Persons desiring to sell fireworks within three miles of the city must obtain a city permit.

Garage Sales: No restrictions. However, any signs to be posted may be posted no earlier than 72 hours prior to the event and must be removed within 24 hours after the event.

Noise: Any condition, including noise, which en-dangers safety or health, is offensive to the senses or obstructs the free use of property so as to interfere with the comfortable enjoyment of life or property by the community or neighborhood or by any considerable number of persons constitutes a public nuisance and is prohibited.

Open Burning: Open burning is prohibited within the city limits unless a special permit is obtained from the Lewistown Fire Department.

Seat Belt Use: Seat belt use is required by the driver and all passengers in any motor vehicle. No driver may operate a motor vehicle unless each occupant is wearing a properly adjusted and fastened seat belt.

Snow and Ice Removal: It is the duty of the owner or tenant of any premises within the city to keep the sidewalk in front of and abutting his premises free and safe for pedestrians. Within a reasonable length of time, these persons must remove snow, ice, slush, mud and other threats to safe foot travel and must prevent the accumulation of these items upon the sidewalks. Sidewalks must be cleared from the night’s accumulation of snow by 9 a.m. following such accumulation. Snow from parking lots within the business district may not be dumped in the streets or alleys. Further-more, business owners may not remove snow, ice or slush from the business premises and deposit it on the streets or alleys.

Speed Limits: The local speed limit is 25 mph in town except where otherwise marked. The limit in school zones is 15 mph.

Storage of Salvage: Permanent open storage of salvage, inoperable vehicles, rubbish or other chattel shall not be permitted in any residential district. Storage of salvage in industrial or commercial districts must be stored inside a building or fenced from public view in accordance with city standards. Vehicles left on city streets and unmoved for a period of five days may be considered abandoned and impounded by the city.

Weeds: No owner of any property in the city may permit noxious weeds to grow. No property owner may allow grass, leaves, weeds or other vegetation to accumulate on his property so as to present a fire hazard.
